Royal Decree-Law 6/2022 has been published in the Official State Gazette (BOE), introducing urgent measures as part of the National Plan to address the economic and social consequences of the war in Ukraine.
Among other economic and social measures, Article 46 establishes an extraordinary measure regarding the maximum IPC increase for residential tenancy agreements where the rent is due for adjustment during the period from April 1st to June 30th, 2022.
This measure is not retroactive, so any adjustments made before April 1st are not affected.
The regulation distinguishes between ‘large-scale’ landlords and other landlords, although in all cases it sets a maximum increase of 2%, which is the ceiling of the Competitiveness Guarantee Index.
‘Large-scale’ landlords:
The rent increase may not exceed 2%. In this regard, please note that, for the purposes of this article, a ‘large-scale landlord’ is defined as a natural or legal person who owns more than 10 urban residential properties or a built area of more than 1,500 m² for residential use, excluding garages and storage rooms in all cases.
Other landlords:
The parties may agree on the maximum percentage increase based on the IPC. If the parties fail to reach an agreement, the maximum increase will also be 2%.
