Tourist Licenses can now be transferred in new home sales in Sitges

On June 13, 2023, the Superior Court of Justice of Catalonia (TSJC) issued a resolution on the appeal filed by APARTUR in relation to the HUT Ordinance of the Sitges City Council.

The TSJC has annulled several articles of the ordinance for tourist use of housing in Sitges, approved two years ago. The judge has sided with the employer association APARTUR, which had challenged the municipal regulations. According to the ruling, the ordinance violates the principle of free access to the activity and invades the competences of the Generalitat.

Among the annulled articles, there are the obligation to have a civil liability policy that covers damages to third parties for a value of 300,000 euros and the existence of a disinfection register. Also, the obligation to respond to a police or inspection requirement in less than 30 minutes is annulled.

Other annulled articles affect the obligation to place a sign at the door of the building indicating the tourist activity and providing basic information about the accommodation. The TSJC considers that this duplicates the signage already required by the Generalitat. At the same time, the clause about the assignment of vacant places for the approval of tourist flats is annulled, as it is considered to violate the legal communications regime.

The regulation on the transmission of licenses has also been struck down, which the City Council required to be extinguished at the time of a possible sale of the house. However, the judge points out that the law allows for the subrogation of the right so as not to limit economic activity.

These are the most significant changes:

It will now be possible to transfer the Tourist License in new home sales, and the name change can be made in those carried out previously.

It will no longer be necessary to hire a home insurance with a 300,000€ Civil Liability.

It will not be necessary to place an informative sign on the door of the house.

There will not be an obligation to respond to a police or inspection requirement in less than 30 minutes.

The system for assigning vacant Tourist Licenses through a waiting list is cancelled.
